§1 Scope and Contracting Party

1.1 These Terms and Conditions (T&C) apply to all household services and handwork performed by Dynaev GMBH under the brand «MeinTüftler». The sole contractual partner is Dynaev GMBH.

1.2 Incorporation: Online booking, email, WhatsApp, telephone.

§2 Scope of Services

2.1 Services: Minor repairs, furniture assembly (IKEA/flatpack), painting work, installations not requiring permits, carpentry work, household assistance, general handwork.

2.2 Legal Classification: Contract for work (Art. 363 Swiss Code of Obligations) for a definable result; service contract (Art. 394 Swiss Code of Obligations) for pure services without guarantee of result.

2.3 Legal Limits — Electrical Work (NIV-Compliant): Dynaev GMBH performs electrical work exclusively within the legally permitted scope pursuant to the Swiss Low Voltage Installation Ordinance (NIV, SR 734.27):

We can recommend qualified electrician partner companies upon request.

2.4 Additional Legal Limits:

Gas installations: Exclusively by licensed gas professionals with SVGW approval.

§3 Offer and Contract Conclusion

Protective extra-low voltage <50V AC / <120V DC (e.g. LED strips, smart home sensors)

§4 Prices and Payment Terms

Standard handwork: CHF 70.–/hour

All prices in CHF. Dynaev GMBH is not subject to value added tax (Art. 10 Para. 2 lit. a Swiss VAT Act). No VAT is charged.

2.4 Additional Legal Limits:

4.3 Travel: Included in minimum charge for within ±20km of Silenen; beyond that CHF 0.80/km.

4.4 Materials: Purchase price + 15% handling, shown separately on invoice.

2.5 Permitted Without Licence (Typical MeinTüftler Services): Painting and wallpapering; assembly work (shelves, pictures, TV mounts); furniture assembly; laying laminate/click vinyl; dowel and hanging work; adjusting windows/doors (without main pipes); simple carpentry.

2.6 Materials: Procured upon request — purchase price + max. 15% handling fee.

§3 Offer and Contract Conclusion

3.1 Free site visit (30 min.) upon request. Offer validity: 14 days.

3.2 Contract concluded by written acceptance (email, WhatsApp, online).

§4 Prices and Payment Terms

4.1 Hourly Rates:

Provide electricity and water

Complete information (wall material, pipe routing, floor type, underground cables)

Secure children, animals, and fragile items

4.2 Minimum Charge: CHF 120.– (approx. 1.5h incl. travel within 20km radius of Silenen).

4.3 Travel: Included in minimum charge for within ±20km of Silenen; beyond that CHF 0.80/km.

4.4 Materials: Purchase price + 15% handling, shown separately on invoice.

4.5 Payment methods: cash payment; bank transfer (QR bill/eBill, CH IBAN); TWINT; Visa/Mastercard; PayPal; invoice only by prior agreement (net 15 days). The payment method available for the specific order is bindingly indicated in the offer, order confirmation, payment link or invoice. Undisputed portions of claims remain payable on time even in case of complaint; disputed items are reviewed under the complaint procedure.

Payment processing: Technical payment processing is carried out via Stripe and/or PostFinance and their connected acceptance partners.

TWINT notice: If TWINT is selected, service performance may be provided at a later time. The service date stated in the offer/order confirmation is decisive.

4.6 Additional Work: Communicated in advance and charged according to actual effort.

§5 Cancellation Policy

7.4 Priority: rectification; if unsuccessful: reduction in price or damages.

7.5 IKEA/Flatpack: Warranty applies only to the craftsmanship (assembly work), not to manufacturer material defects or damage to particleboard material during disassembly and reassembly.

§8 Liability

8.1 Liability only in cases of gross negligence or intent (Art. 100 Para. 1 Swiss Code of Obligations).

8.2 Liability Limit: CHF 30,000.– per claim.

8.3 Commercial Liability Insurance: Angaben zur Betriebshaftpflicht (Versicherer, Deckungssumme, Geltungsbereich) werden dem Auftraggeber auf Anfrage in der jeweils aktuellen Fassung zur Verfügung gestellt.

8.4 Exclusions: Damage caused by incorrect information from the client (especially undeclared pipe routing); consequential damage from unrecognised pre-existing damage; work on IKEA/particleboard furniture.

§9 Subcontracting

Use of qualified subcontractors is permitted. Dynaev GMBH remains the sole contractual partner.

§13 Non-Solicitation Clause

The client is prohibited from directly or indirectly employing, engaging, or soliciting employees or subcontractors used by the service provider during the contractual relationship and for 12 months after the end of the contract. In case of violation, a contractual penalty of CHF 2,000.– per case is due, without prejudice to the assertion of higher proven damages.

Cancellation, Distance Contracts and Early Performance

1. No blanket general 14-day withdrawal right applies to all bookings.

§7 Warranty (Contract for Work)

7.1 Warranty pursuant to Art. 367–371 Swiss Code of Obligations.

7.2 Duty to Notify: Visible defects must be reported immediately upon acceptance + in writing within 5 working days; hidden defects in writing within 5 working days of discovery.

7.3 Limitation Period: 2 years from acceptance for moveable goods; in case of deliberate concealment of defects: 10 years (Art. 371 Swiss Code of Obligations).

7.4 Priority: rectification; if unsuccessful: reduction in price or damages.

16.2 Warranty Case: For defects, the procedure pursuant to §7 applies (duty to notify, right to rectification).

16.3 Mediation: For unresolved disputes: mediation service of Canton Uri. Mediation attempt is mandatory before initiating legal proceedings (CPC).

§13 Non-Solicitation Clause

Mandatory statutory venues remain reserved (in particular consumer-protection venues); subsidiary venue is Silenen, Canton Uri. Swiss law applies.

§14 Withdrawal and Cancellation for Distance Contracts

14.2 The withdrawal and cancellation rules agreed in the specific offer, order confirmation and these Terms shall apply.

14.3 If the service is started early at the express request of the customer, services already provided and expenses incurred must be reimbursed.

14.4 Declarations of withdrawal must be submitted in writing to hello@meintueftler.ch.

§15 Force Majeure

15.1 Definition: Force majeure includes natural disasters, pandemics, official orders, road closures, strikes, significant material shortages, and other unforeseeable events outside the control of Dynaev GMBH.

15.2 Legal Consequences: In the event of force majeure, Dynaev GMBH is released from the obligation to perform without liability. Payments already made will be refunded pro rata.

15.3 Duty to Inform: Immediate notification to the client; free rescheduling within 14 days.

15.4 Duration: If force majeure lasts longer than 30 days, both parties have the right to dissolve the contract without cost consequences.
